A detailed case study of a successful constitutional challenge to pre-trial detention conditions, resulting in a binding ruling requiring systemic improvements to Georgia's remand facilities.
In this case, our client had been held in pre-trial detention for 14 months in conditions that fell below the minimum standards required by Article 3 of the ECHR and Article 17 of the Georgian Constitution. The Constitutional Court's ruling marked the first time the Court had ordered the legislature to introduce mandatory minimum standards for remand facilities, with a compliance deadline binding on the executive branch.
