Constitutional Court Reinforces Property Rights in Landmark Ruling

In a significant ruling issued last month, the Constitutional Court of Georgia reaffirmed the principle that legislative interference with property rights must satisfy strict proportionality requirements.

The Constitutional Court of Georgia, in its March 2026 decision, addressed a challenge to legislation restricting the alienation of agricultural land by foreign nationals. The Court held that while the state has a legitimate interest in regulating land ownership, the blanket prohibition at issue failed the proportionality test under Article 19 of the Constitution.
