Three cases in which Ultima Legal challenged disproportionate restrictions on public assembly — and what they collectively establish about the limits of police discretion under Georgian and European law.
Across three cases litigated between 2023 and 2025, a consistent principle emerged: the discretion of police commanders to disperse public assemblies is subject to strict judicial scrutiny and must be exercised only where the gathering poses a clear, present, and proportionate threat to public order. In all three cases, the courts found that the dispersals were unlawful and awarded compensation to the applicants.
